According to the Spanish legislation foreign citizens have the same right of buying real estate in Spain with the Spanish. The only document you’ll need is a valid passport, so you will not have to collect any other certificates or permits.
Before buying real estate in Spain we recommend you to get acquainted with all the possible variants. You shouldn’t rely only on photos, because besides the outward appearance and the interior, you should pay your attention on the area and surroundings.
It’s up to the seller to pay for the services of the estate agency. A buyer shouldn’t pay the agency. Unfortunately, some unfair agencies try to make double profit by making the buyers pay them.
Spanish real estate agencies don’t sell real estate directly. Their responsibility is looking for some variants and giving juridical help, when making a deal. There can be an exception in case the agency has a proxy document on making the deal. If there is a proxy document, the agency gets the right to make an advance payment and to sign down the contract.
Before buying real estate in Spain, you should go to the notary's office for getting NIE. You’ll need NIE for the discharge of tax.
Spanish documents, considering real estate, are an escricture, which confirms that the seller truly owns a realty, and Nota Simple – an extract from the register, which claims that the real estate isn’t under arrest or mortgaged. Besides that, you should check the receipt of paying the city taxes (IBI) before you buy real estate property in Spain.
